Recare reserves the right to change or alter any pricing or order forms shown on the website at any time without notice. Recare reserves the right to revoke, without informing clients, orders placed under incorrect pricing, and to revise the website pricing and order forms shown without notice in line with the provision of pricing supplied by manufacturers of the products. As the products supplied are unique to clients prescriptions, needs and requirements the published pricing is a starting from price, showing the minimum value at which the product showed is purchasable. The prices provided by manufacturers changes routinely and Recare will endeavour to update the starting from price and order forms within a reasonable timescale without notice.

Orders

By placing an order with us you will be deemed to have read, understood and agreed to these Terms and Conditions. If you are unhappy with any aspect of these terms, then you should contact us before placing an order. Ways to contact us are displayed on the Contact Us page of the Site.

The seller shall sell, and the buyer shall purchase the goods in accordance with any written quotation issued by the seller which is accepted by the buyer or any written order of the buyer which is accepted by the seller.

The seller’s employees are not authorised to make any representations concerning the goods unless confirmed by the seller in writing. In entering into the contract, the buyer acknowledges that it does not rely on, and waives any claim for breach of any such representations which are not so confirmed.

Any typographical, clerical, or other error or omission in any sales literature, quotation, price list, order acknowledgement, invoice or other document issued by the seller shall be subject to correction without any liability on the part of the seller.

By placing an order with us you will be deemed to have read, understood, and agreed to these Terms and Conditions.

Delivery

Estimated delivery times will be advised when ordering. Any dates quoted for delivery of the goods are approximate only and the seller shall not be liable for any delay in delivery of the goods howsoever caused. We are unable to guarantee delivery on or by a specific date.

Appointments for handover of equipment will be agreed with the buyer once all goods are received by the seller and are ready for delivery.

Prices and VAT

Prices stated on the seller’s website and in all publications are in Pounds Sterling. Unless otherwise agreed, payment is required in pounds sterling.

The price of the goods shall be the quoted price, or where no quotation has been provided shall be the price stated on the sales order acknowledgement. All prices quoted are valid for 28 days. The price is exclusive of any applicable value added tax which the buyer may be additionally liable to pay to the seller. Eligibility for VAT exemption on the grounds of disability or medical condition must be confirmed in writing by completing the VAT Exemption form.

Payment Terms

A minimum of 50% of the full order value will be payable on acceptance of the quotation. Full order value includes all goods, labour, applicable delivery charges and VAT, less any confirmed NHS voucher contributions. The remaining balance is payable on delivery. Any charity contributions being paid directly to the seller by the charity must be advised at the time of ordering. The buyer will be liable for the full balance until settled.

Any amendments to the order made prior to delivery will be adjusted for in the final balance unless such amendments result in an increase to the total order value of £1,000, for which 50% payment will be required on order.

We reserve the right to request 100% payment in advance of any parts or equipment being ordered.

Risk of damage to or loss of the goods shall pass to the buyer at such time as the buyer is notified that the goods are available for collection or at time of delivery to the buyer.

Notwithstanding delivery and the passing of risk in the goods, legal title of the goods shall not pass to the buyer until full settlement of all invoices relating to the order has been received by the seller

Returns and Refunds

Items that are not of a personal nature and that have not been custom-made or customised to the buyer’s requirements can be returned for exchange or refund within 14 days of receipt. Any request to return an item, whether for refund or exchange must be made and approved by the seller prior to the goods being returned. The seller reserves the right to charge a restocking fee of 20% of the purchase price for returns of non-faulty products.

Any costs involved in returning products will be met by the buyer, unless the seller accepts the items were damaged or faulty on delivery. We are unable to receive for refund or exchange any items that are of a personal or customised nature unless they are damaged or faulty.  

The items must be returned complete, in perfect condition, unused and in the original packaging. Any costs incurred by the seller in relation to the return of any non-damaged or faulty items may be deducted from any refund. Postage, packaging, or any other shipping fees are not refundable unless the item is being returned as faulty.

Orders received faulty or damaged must be notified to the seller within 5 days of receipt and where requested, should be returned, complete and, wherever possible, with the original packaging within 14 days of receipt.  We cannot accept an item returned as faulty or damaged if reasonable care of the product has not been taken, or where instructions relating to the use of the product have not been followed or where the damage caused to the product is due to wear and tear or misuse.

Refunds for approved returns will be made directly to the original source of payment. Refunds will usually be processed within 24 hours of receipt of the returned goods but please allow up to 7 days for refunds to be processed.

Nothing in these terms and conditions affect your statutory rights as a consumer.

Cancellations

No order which has been accepted by the seller may be cancelled by the buyer except with the agreement in writing of the seller and on terms that the buyer shall indemnify the seller in full against all costs, charges and expenses incurred as a result of cancellation.

The seller reserves the right to charge a call out fee in line with the standard charges for any visits made by the seller, to the buyer prior to cancellation, for such assessments as were reasonably required for the fulfilment of the order. Such costs may be invoiced to the buyer and deducted from any monies already paid before refund is made. The buyer will be liable for such costs to the extent that they exceed monies already paid.

Where a buyer is unable to complete the purchase of goods (due to unforeseen long-term changes in health conditions, hospitalisation, or death) subsequent to an order being placed with the manufacturer, the seller will endeavour to cancel the order or where this is not possible, to find an alternative buyer. Monies already paid by the buyer, or on behalf of the buyer, will be refunded only to the extent that the seller does not suffer any financial loss as a result.  Where the goods have already been received by the seller or are in transit to the seller on notification of the change, full payment of the total order value will be due.

Warranties and Guarantees

Unless otherwise stated, products purchased from the seller are guaranteed for a period of 1 year. This excludes items of a consumable or disposable nature, or items that would reasonably be expected to have a limited life.

All major equipment will be supplied with a manufacturer warranty as detailed on order. General wear and tear or damage resulting from misuse will not be covered under warranty.

The seller reserves the right to charge a call out fee for labour and travel costs for any visits where parts are covered under warranty.  Such charge will be at the discretion of the company.

Events Beyond Our Reasonable Control

The seller will be under no liability for any delay or failure to deliver products or otherwise perform any obligation as specified in these terms and conditions if the same is wholly or partly caused, whether directly or indirectly, by circumstances beyond its reasonable control.

Waiver

If the buyer breaches these conditions and the seller takes no action, the seller will still be entitled to use its rights and remedies in any other situation where the buyer breaches these conditions.

Governing Law & Jurisdiction

These terms and conditions and any contract between us shall be governed by the laws of England and any dispute between us will be resolved exclusively in the courts of England. Any notice required or permitted to be given by the buyer to the seller under these conditions shall be in writing addressed to its registered office or principal place of business or by email to info@recare.co.uk.
